Public Hearing Notice

In accordance with the provisions of Chapter 40A of the Massachusetts General Laws, the Millbury Planning Board will hold a public hearing on Monday, May 10, 2021 at 7:30 p.m. on the application of Whitney Street Home Builders, LLC, property located at 17 Rice Road, Millbury, MA, for a Multi-Family Special Permit under Millbury Zoning Bylaws, Article 1, Section 14.11 (a), Site Plan Review under Zoning Bylaws, Article 1, Section 12.4, and for a Post-Construction Storm Water Management Permit under Millbury Municipal Code, Title 13, Chapter 13.15. The Applicant seeks approval for a multi-family development consisting of 52 duplex units and associated improvements.

Multi-Family Special Permit

Millbury Zoning Bylaws, Article 1, Section 14.11 (a)

14.11 Planning Board Authority. The Planning Board shall act as the special permit granting authority for the following special permits:

(a) Multifamily use in Residential, Residential (Office), Suburban and
Business I Districts (By-Laws 4-5-86, Art. 51, Section 2)

Site Plan Review

12.4 Site Plan Review. To protect the health, safety, convenience and general welfare of the inhabitants of the town by providing for a review of plans for uses and structures which may have significant impacts on traffic, municipal and public services and utilities, environmental quality, community values in the town and community economics.

Post-Construction Storm Water Management Permit

Millbury Municipal Code, Title 13, Chapter 13.15

Chapter 13.15. (a) Regulation of discharges to the municipal separate storm sewer system (MS4) is necessary for the protection of the town of Millbury’s water bodies and groundwater, and to safeguard the public health, safety, welfare and the environment. Increased and contaminated storm water runoff associated with developed land uses and the accompanying increase in impervious surface are major causes of:

  1. Impairment of water quality and flow in lakes, ponds, streams, rivers, wetlands and groundwater;

  2. Contamination of drinking water supplies;

  3. Erosion of stream channels;

  4. Alteration or destruction of aquatic and wildlife habitat; and

  5. Flooding.

Therefore, this chapter establishes storm water management standards for the final conditions that result from development and redevelopment projects to minimize adverse impacts off site and downstream which would be borne by abutters, townspeople and the general public.
